crewASAP Partner Program Terms

These terms are an agreement between you and CrewMotive LLC, which operates crewASAP ("crewASAP," "we," "us"). By signing up for the crewASAP Partner Program (the "Program"), you agree to these terms. If you do not agree, do not join the Program.

1. What the Program is

The Program lets you refer contractors to crewASAP and earn a commission when they become paying members. You join as an independent partner. You are not an employee, agent, franchisee, or legal partner of crewASAP, and you have no authority to make promises, sign agreements, or accept payments on our behalf.

2. Who can join

You must be at least 18 years old and able to enter into a binding agreement. You must give us accurate contact information and keep it current. We may decline or remove any application or partner at our discretion.

3. How referrals are credited

• You receive a unique referral link. A referral is credited to you only when a contractor uses your link and completes a paid crewASAP membership signup.
• Referral tracking uses a browser cookie that lasts up to 365 days. If a contractor clears cookies, uses a different device or browser, or signs up without using your link, the referral may not be credited.
• A referral is not eligible if the contractor was already a paying crewASAP member, or if you own, manage, or control the business that signs up (no self-referrals).
• If more than one partner could be credited, our tracking system's record decides. Our records are final for crediting referrals and calculating commissions.

4. Commissions

• You earn 25% of each membership payment we actually receive from a contractor credited to you, for as long as that contractor's account stays active and paying.
• Commissions are calculated on the amount we collect, not including sales tax, refunds, chargebacks, or credits.
• If a contractor you referred moves to a different membership level, your commission is based on what they pay after the change.
• Commissions stop when the contractor cancels, stops paying, or their account is closed.
• If a payment is refunded or charged back, the commission on that payment is canceled. If we already paid it, we may subtract it from your future commissions.

5. Getting paid

• Commissions from payments received in a calendar month are scheduled to be paid on or around the 30th day of the following month. We may hold a commission for review if a payment is disputed, refunded, or appears fraudulent.
• We pay by PayPal or bank transfer, using the payout method you add in your partner dashboard.
• Before we can pay you, you must add a valid payout method and submit a completed tax form (Form W-9 for U.S. partners). We are not responsible for delays caused by missing or incorrect payout or tax information.
• You are responsible for any taxes on your commissions. We may issue tax forms as required by law.

6. Telling people you earn a commission

The disclosure must be easy to see, placed near the recommendation, and not hidden in fine print or a separate page.

7. How you may promote crewASAP

You may share your link through personal conversations, texts and emails to people who know you, your own social media, and your own website or newsletter. You agree that you will not:

• Send spam, or send texts, calls, or emails to people who have not agreed to hear from you, or otherwise break laws that govern calls, texts, and email marketing.
• Make false or misleading claims about crewASAP, including promising a specific number of jobs, leads, rankings, or income.
• Present yourself as crewASAP, CrewMotive, or one of our employees.
• Run paid ads that use crewASAP or CrewMotive names or trademarks as keywords, or that send traffic directly to our pages, without our written permission.
• Offer discounts, rebates, cash, or other incentives to get someone to join, unless we approve it in writing.
• Use fake signups, cookie stuffing, automated traffic, or any other method that creates referrals that are not genuine.

8. Using our name and materials

While you are in the Program, you may use the crewASAP name and any materials we provide to you, only to promote crewASAP under these terms. You may not change our logos or create materials that look like they came from us without permission. This permission ends automatically when you leave the Program or are removed.

9. Leaving or being removed

• You may leave the Program at any time by emailing us. We may end the Program, or remove you from it, at any time.
• If you leave, or we remove you for any reason other than a violation of these terms, we will pay commissions on payments we received before the removal date, on the normal schedule. No commissions are earned on payments received after that date.
• If we remove you because you violated these terms or engaged in fraud, any unpaid commissions are forfeited.

10. Changes to these terms

We may update these terms, including the commission rate or payout schedule. We will email you at least 30 days before any change to the commission rate or payout schedule takes effect. Changes never reduce commissions on payments we already received. If you keep participating after a change takes effect, you accept the updated terms.

11. Information and privacy

We use the information you give us to run the Program, credit your referrals, communicate with you, and pay you. Do not share personal information about contractors or homeowners with us unless you have the right to share it. Keep any non-public information about the Program or our business confidential.

12. Responsibility and liability

• You are responsible for how you promote crewASAP. You agree to cover any claims, losses, or costs that result from your violation of these terms or of any law in connection with your promotion.
• The Program is provided "as is." We do not guarantee that tracking will be uninterrupted or error-free, or that you will earn any amount.
• To the extent allowed by law, we are not liable for indirect, incidental, or consequential damages, and our total liability to you under these terms will not exceed the commissions we paid you in the 12 months before the claim.

13. General

• These terms are governed by the laws of the State of Ohio.
• These terms are the entire agreement between you and crewASAP about the Program. Your participation is non-exclusive, and nothing here requires either of us to do business only with the other.
• If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a provision right away, we can still enforce it later.
